Luxury Beach Holidays is trading name of I Konnect Limited which is incorporated in England (company registration number 07538997.(In below terms I Konnect will be referred as “Luxury Beach Holidays/we/us”).

Luxury Beach Holidays respects your privacy and is committed to protecting your personal data. This privacy policy sets out our approach to the personal data we collect from or obtain about you. What is the purpose of this privacy policy?

At Luxury Beach Holidays we are very serious about protecting your privacy. Your trust is our most important asset. This privacy policy explains what personal data Luxury Beach Holidays may collect from you and why and what we will do with this data.

From 25 May 2018, you and your personal data will be protected by the EU General Data Protection Regulation (which is otherwise known as GDPR) and a new UK Data Protection Act 2018. In this privacy notice, we refer to this legislation as data protection laws.

We will only process your personal data as set out in our privacy policy or otherwise notified to or agreed by you or as we are otherwise permitted to do in accordance with data protection laws.

What is our role in relation to your personal data?

For the purposes of data protection laws, we, Luxury Beach Holidays, are usually a data controller in respect of the personal data you provide us with or which otherwise comes into our possession. For certain types of holiday bookings, we may however be a data processor. This is likely to be the case where we contract with a third party such as a travel agent, travel planner or other travel business which is based outside the UK for the arrangement of travel services and which itself enters into a contract with you for the provision of your holiday. In this situation, that travel business is likely to be the data controller. Where we are a data processor, we will only process your personal data in accordance with the instructions of the data controller. Certain provisions of this privacy policy will be applicable where we are the data processor.

What data do we need and how will we do this?

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

This includes data relating specifically to your identity, such as your first name, last name, marital status, title, date of birth and gender. This includes data relating to how you may be contacted, such as your postal address, email address and telephone numbers.

This includes data relating to your means and methods of payment, such as your bank account and payment card details.

This includes data relating to the transactions you have carried out with us, such as details about payments to and from you and other details of products and services you have purchased from us.

This includes more technical data that we may obtain when you make use of our website, access our marketing information or contact us by email or phone including: Browsing, form filling and search history. We may also use software tools such as Google Analytics to measure and collect session information, length of visits to certain pages, repeat visits and page interaction information (such as clicks and mouse movements).

This includes information about how you use our website, products and services.

This includes information about the domain and IP address that your computer uses to connect to the internet; your computer, browser, operating system, internet connection, referral information, search terms and other standard information collected by default by tools such as Google Analytics.

Telephone information including phone numbers, call duration and call recordings that we use for training and quality control.

Third party information about you from other sources which we may add to our account information.

This includes your preferences in relation to whether or not you want to receive marketing from us and also your communication preferences.

You may provide or we may otherwise obtain personal data to us in various ways. This may be as a result of our direct communications through a contact us page on our website or other technological tools or advertisement on the different medias or through a third party such as a travel agent . We have provided examples of the personal data we process below. This may be provided over the telephone, on-line through our website or in emails to us. Additionally, in order to allow you to experience a more personalised service when you visit our website, we may find out about your interests. We may do so by asking you to provide this information, by reading your comments and/or by looking at the areas of our website you have visited 

Please do not provide your personal data to us if you are not happy for us to process this information in accordance with this privacy policy.

Examples of when and how we may collect your personal information include the following:

If you order a brochure or newsletter we will ask for your name, address and e-mail address. This is so we can effectively e-mail or post out the requested items.

If you submit a holiday enquiry form we will ask for your name, telephone number and e-mail address. This is so we can effectively respond to your request.

If you enter a competition or promotion we will ask for your name, address and e-mail address. This is so we can run the competition effectively and let you know if you have won or allow you to participate in the promotion. If we would like to use the personal data you have provided for any purpose in addition to the specific competition or promotion, we will make this clear and seek your specific consent to this.

If you want to make a booking with us, we will ask for the personal information of all persons travelling. This is likely to include the personal data set out above. This is required so that we can make and provide your holiday arrangements.

Special Categories of Personal Data

Where necessary, we may collect the following special categories of personal data about you:

 Details about dietary requirements which may disclose your religious or philosophical beliefs

 Details about health.

We collect and process the above data only where it is strictly necessary to do so in order to deliver the travel service that you have purchased, examples include where we need to book in-flight catering, arrange special airport assistance at the airport for you or apply trade union member discounts. Furthermore, we will only collect and process the above special categories of sensitive personal data where you have provided us with your explicit consent to do so.

You are not under any obligation to consent to us processing your sensitive personal data. However, without your consent, we won’t be able to make the necessary arrangements to provide the travel services that you have booked or are attempting to book. As a result, if you do not provide your consent, we will be unable to proceed with your booking.

If you are happy to consent to our use of your sensitive personal data, you will also be able to withdraw your consent at any time. However, as this will prevent us from providing the travel service you have booked, we will be required to treat any withdrawal of consent as a cancellation of your booking and the cancellations as defined in our Booking Terms and Conditions will become payable.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may either not be able to process your booking or we may have to cancel your booking, in which case we will treat as a cancellation by you and accordingly the cancellations policies will get applied as defined in our .

 Who do we share your personal information with?

Where you make a booking or booking enquiry, appropriate personal data will be passed on to the relevant suppliers (such as airlines, hotels, villas, resorts, car hire, cruise, other excursions companies etc.) and any other third party (such as banks and/or credit card companies) who need this information so that your chosen arrangements can be booked and provided or your booking enquiry answered. Once your booking has been made, your personal data may also be provided to government / public authorities such as customs or immigration if required by them, or as required by law. Certain information may also be passed on to security or credit checking companies.

We may also make personal data available to companies who provide services on our behalf, such as mailing brochures and marketing material.

We only provide third parties with the personal data they require in order to deliver their services. Other than in relation to government / public authorities (over whom we have no control), we will take appropriate steps which are intended to ensure that anyone to whom we pass your personal data for any reason agrees to keep it secure, only uses it for the purpose of providing their services and does not collect any personal data from you in the course of performing their services.

We use personal information to let you know about our products and services that we think may be of interest to you.  This may be based on your preferences, derived from Cookies, inferred from your interactions with us including on our social media accounts or market research.  We may also let you know about our corporate services which we believe may be relevant to you in a professional capacity.

We also work with social media and other digital platforms to provide you with advertisements within those platforms. We provide them with your name and contact details (such as your email address or phone numbers).  If these social media and digital platforms match profile information provided by us with your profile information held by them then they will serve you our advertisements. The social media platforms will not identify you or share other personal information in your social media account to us. 

We will only send you direct marketing, whether about us, carefully selected third parties or partners, products or services, in accordance with your marketing preferences.  We may contact you by email, SMS/text, social media, or through other communication channels that we think you may find helpful.  If at any time you would like us to stop sending you marketing material, contact us or choose the relevant “unsubscribe” option.

Use of our website

When you use our website we use software to help us to see usage and trends. It also records your IP address and allows us to see what pages are being looked at – allowing us to improve our services and marketing. It does not record your name and email address unless you complete an on line booking request. Our site contains links to and from the websites of attractions, destinations, hotel, villas, resorts etc. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies or for these 3rd party websites. Please check these policies before you submit any personal data to these websites. COOKIES – The website does not store any personal information such as your name, address or email. The cookies we use are ‘analytical’ cookies and, as well as ensuring that our website offers the best possible service to you, they also allow us to recognise and count the number of visitors to our website and to see how visitors move around the site when they’re using it. All of which is incredibly useful for understanding what visitors require from us and ultimately for improving the functionality of our website. When we share your information overseas

We share your personal data within the Company. This will involve transferring your data within the European Economic Area (EEA).Many of our external third parties are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.

Where you have made a booking of travel services which are located or otherwise due to be fulfilled outside the EEA, we are required and are permitted to transfer your personal data to the supplier of the services that you have purchased, outside the EEA in order to where we act as agent, to place you into a contract with the supplier and so that the supplier can fulfil the contract they have with you and in order to make your booking.

Where we are unable to rely on one of the safeguards outlined below when transferring data to those suppliers outside the EEA, we will rely on the derogation under Article 49 of the GDPR in order to transfer your personal data to countries outside the EEA (as the transfer relates to the performance of a contract for your benefit), and you hereby permit us to do so. You also acknowledge that where your personal data is transferred outside the EEA, controls on data protection may not be as wide as the legal requirements within the EEA.

How do we secure your personal  information?

We take the security of your personal information very seriously indeed and so we have taken appropriate security measures to protect this information. As such all information collected by us is kept securely and can only be accessed by the employees of Luxury Beach Holidaysl. Also we have put in place appropriate technical, and organisational, measures to prevent the unauthorized processing of personal information and the accidental loss, or destruction of, this data. However as no system can be said to be totally secure we do not, and cannot, guarantee the total security, or the complete accuracy, of the information we hold.

Should you wish us to delete your personal information at any time then please contact us (details below) and we will ensure a secure deletion of this information.  

How Long Do We Hold Your Data?

We will only hold your personal information for such time as is reasonably necessary to carry out the services we have agreed to provide you with, to satisfy any legal & tax requirements, and also to service our relationship with you as a tour operator providing bespoke travel arrangements.

What are your rights?

At any time you have the following rights and on giving us the appropriate notice you are entitled to:

(i) request a copy of the personal information that we hold;

(ii) Request that your personal information be corrected where inaccurate or incomplete;

(iii) Request that your personal information be deleted, or that we stop using your personal information where it is no longer necessary (the right to be forgotten);

(iv) Request that we stop sending you direct marketing communications. Alternatively you can always opt out of receiving our monthly newsletter by using the unsubscribe button at the bottom of the newsletter.

Can you ask us to delete your personal data?

Yes, you can ask us to erase/remove your personal data in certain circumstances, for example where you have withdrawn your consent to further marketing where the data in question has only been processed for this purpose our further using this for marketing purposes. However, this is not always the case. Please see the previous paragraph for further information on the period of time we may retain personal data.

Can this privacy policy be changed?

Yes, from time to time we may need to make changes to this privacy policy. These may be required as a result of changes in data protection laws or in the guidance issued by regulators such as the Information Commissioner’s Office (which is usually referred to as the ICO) or where we make changes to our procedures. The latest version of this privacy policy will be on our website.

What should I do if I have a complaint about the processing of my personal data?
